EB-1 Extraordinary Ability

An individual may be eligible for an employment-based, first-preference EB-1 visa if he/she has an extraordinary ability, is an outstanding educator/academic or is a multinational executive or manager.

Each specific occupational category has particular requirements that must be met. Employers must sponsor their employee by filing USCIS Form I-140, Petition for Alien Worker in cases involving Outstanding Professors/Researchers or Managers/Executives.

Foreign nationals holding O-1 or L-1 nonimmigrant visa status often qualify for immigrant status under this category.

Extraordinary Ability

The person must be able to demonstrate extraordinary ability in the sciences, arts, education, business, or athletics, e.g. has received the Pulitzer price, an Oscar, or an Olympic Medal.

Outstanding Professors and Researchers

The person must demonstrate international recognition for outstanding achievements in a particular academic field. He/she must have at least 3 years experience in teaching or research in that academic area. An offer of employment from a prospective U.S. employer is required.

Multinational Manager or Executive

The petitioning employer must be a U.S. employer, and must have been doing business for at least 1 year, as an affiliate, a subsidiary, or as the same corporation or other legal entity that employed the person abroad.
